1. Definitions
“We”, “us” and “our” mean Timbershedco, operated by ETRAPSHORTS LLC. “You” means the person placing an order or using the site. “Goods” means the products listed for sale on the site. “Consumer” has the meaning given in the Consumer Rights Act 2015.
2. Acceptance of these terms
Using the site or placing an order means you accept these terms and our privacy policy, refund policy, shipping policy, payment policy and cookie policy, which all form part of the contract between us. If you do not accept them, please do not use the site.
3. Use of the website
You may browse, order and print pages for your own use. You may not use the site for any unlawful purpose, attempt to gain unauthorised access to it, scrape it systematically, or introduce malicious code. We may suspend access to the site for maintenance or where we reasonably believe these terms are being breached.
4. Products, prices and VAT
We take care to describe our goods accurately, and every product page carries a dimensions and materials table. Timber is a natural material: small knots, minor colour variation between boards and gradual weathering from honey-brown towards silver-grey are normal and are not defects. Photographs are representative; the exact grain of your item will differ.
All prices include VAT. Delivery is free to any United Kingdom address with no minimum spend, so the price displayed on the product page is the total amount payable. Prices may change at any time, but a change never affects an order we have already accepted.
If we discover an obvious pricing error before dispatch, we will contact you and give you the choice of paying the correct price or cancelling for a full refund. We will never simply charge you more.
5. How a contract is formed
Our display of products is an invitation to treat, not an offer. Your order is an offer to buy; a contract is formed only when we accept your order by sending a dispatch confirmation. The order-acknowledgement e-mail is not an acceptance. If we cannot supply an item we will tell you and refund any payment taken in full.
6. Title and risk
Title to the goods passes to you on receipt of payment in full. Risk in the goods passes to you when they are delivered to the address you gave, or to a neighbour or safe place at your instruction.
7. Payment
We accept Visa, Mastercard, American Express, Apple Pay and Google Pay. Payments are processed by Stripe over an encrypted connection; we never see or store your full card number. Payment is taken when you place the order. See our payment policy for detail.
8. Delivery
We ship to the United Kingdom only. Dispatch takes 1 – 2 business days and transit 5 – 7 business days on a tracked DPD or Parcelforce service, so orders arrive within 6 – 9 business days. Delivery is free with no minimum spend. Full terms, including what happens if a delivery is late or damaged, are in our shipping policy.
9. Cancellation, returns and exchanges
You have a statutory right to cancel within 14 days under the Consumer Contracts Regulations 2013, and a voluntary 30-day return window on top of it. We accept exchanges and never charge a restocking fee. The full process, the model cancellation form and who pays return postage are set out in our refund policy.
10. Your statutory rights and warranty
Under the Consumer Rights Act 2015, goods must be as described, fit for purpose and of satisfactory quality. If goods are faulty you have a 30-day short-term right to reject them for a full refund, and thereafter the right to a repair or replacement. Nothing in these terms affects these statutory rights.
Our timber is pressure-treated against rot and insect attack. This protection depends on the goods being assembled according to the instructions, on a firm, level, free-draining base, and not being cut, drilled through the treated surface or installed in standing water.
11. Assembly and safety
Our goods are supplied flat-packed for self-assembly. Follow the supplied instructions, wear gloves and eye protection when handling timber and fixings, and use two people for the shed, bike store and bin store panels. We are not responsible for damage or injury caused by assembly that departs from the instructions, or by installation on an unsuitable base.
12. Intellectual property
All text, photographs, product descriptions, layout and the Timbershedco name and logo on this site belong to us or our licensors. You may not copy, reproduce or republish them for commercial purposes without our written permission.
13. User content
If you submit a review or other content, you grant us a non-exclusive, royalty-free licence to display it on the site. You confirm the content is your own, accurate and not unlawful. We may remove content that is abusive, misleading or infringes someone else’s rights.
14. Privacy
We process personal data as described in our privacy policy, in accordance with the UK GDPR and the Data Protection Act 2018.
15. Liability
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law – including your rights under the Consumer Rights Act 2015. Subject to that, our total liability for any claim connected with an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, or for loss of profit or business, where you are not a consumer.
16. Your responsibilities
You are responsible for giving us an accurate delivery address and contact details, for being available to receive delivery or giving the carrier a valid instruction, for checking that a building fits the space and complies with any local planning or tenancy rules that apply to you, and for preparing a suitable base before assembly.
17. Third-party links
The site links to third-party sites, such as carrier tracking pages. We do not control them and are not responsible for their content or their privacy practices.
18. Events beyond our control
We are not liable for delay or failure caused by events beyond our reasonable control, including severe weather, carrier network failure, industrial action, fire, flood or restrictions imposed by a public authority. If such an event occurs we will contact you and, if the delay is substantial, you may cancel and receive a full refund.
19. Complaints and dispute resolution
Please contact our customer service first: e-mail contact@timbershedco.com with “complaint” in the subject line. We acknowledge every complaint within one business day and aim to resolve it within five. If we cannot resolve your complaint, you may refer it to a relevant Alternative Dispute Resolution scheme or use the small claims track of the county court. Nothing in these terms restricts your statutory rights.
20. Governing law and jurisdiction
These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident in Scotland or Northern Ireland, you keep the protection of the mandatory rules of your local law and may bring proceedings in your local courts.
21. General
If any provision of these terms is found to be unenforceable, the remaining provisions continue in force. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these terms without our written consent. These terms, together with the policies referred to in them, are the entire agreement between us.
22. Changes to these terms
We may update these terms. The version in force is the one published on this page at the moment you place your order, and the date at the top shows when it last changed.
